Below are some commonly used Notices used by landlords. Each Notice should be accompanied by the Declaration of Service when the Notice is delivered to the tenant. Notices To Pay/Perform or Quit

Notices To Quit (Vacate)

  • 3-Day Notice To Quit For Unlawful Acts (Doc 94)
  • 30-Day Notice To Quit (Doc 95)
    • This form can only be used if the tenant in question is in possession of the premises on a month-to-month basis, and the tenant has had possession of the premises for less than one year.
  • 60-Day Notice To Quit WITH Cause (Doc 96)
    • If the tenant has lived at a premises within the City of San Diego for more than two years and is in possession of the premises on a month-to-month or unspecified basis, a landlord must provide a reason for issuing the 60-Day Notice To Quit, pursuant to the San Diego Tenants’ Right To Know Regulations.
  • 60-Day Notice To Quit WITHOUT Cause (Doc 97)
    • If the tenant has lived at the premises for more than one year and less than two years (if within the City of San Diego) and is in possession of the premises on a month-to-month or unspecified basis, a landlord does not need to provide a reason for issuing the 60-Day Notice To Quit.
