Amount in Controversy
Lawyering is expensive and we’ll be the first to tell you that it doesn’t make sense to argue over issues where the attorney’s fees cannot be justified relative to the amount in controversy.

Generally speaking, matters need to have an amount in controversy above $40,000 in order to even think about getting a law firm involved. If your client’s matter below $10,000, they are directed to a small claims court. Cases under $10,000–$30,000 have to have a very good reason to justify getting an attorney involved, such as instances where there is confidence around liability or an attorney fee provision. Of course, sometimes clients are the ones being sued and have no choice but to retain an attorney.

Fit & Finish
Does your client fit into our firm’s overall culture, communication style, personality, and areas of expertise? There’s not a perfect way to figure out whether you’re going to be able to build a healthy relationship with a client. Sometimes, it just takes time. That said, to aid in determining a proper fit, we are an aggressive litigation firm that strives to create clear, effective, and aligned expectations between our clients and our firm from the first day we meet them.

Common client Red Flags to watch out for:

1. Clients that are on their 5th attorney.
2. Cases that are on the eve of trial.
3. Clients that have unrealistic expectations and are shopping for an attorney that will promise them a positive outcome.
4. Clients that have unreasonable expections about the cost of litigation or an inability to pay attorney fees.

Expected Delivery: 1–2 days after initial consult and qualification process

Includes the following:
1. Firms hourly rate/ fees
2. Expectations for budgets and milestones

Once this agreement is signed and the initial retainer is paid, we will schedule a kickoff meeting.

Expected Timeframe: 1 week after execution of the Retainer Agreement

Meeting agenda:
1. Introduction of the team
2. Attorney assignment and their associate
3. Formal Expectation and Goal setting in terms of milestones and timeline
4. Review the Legal Proceedings Process

Status Check Meetings
Overall Goal: To track completed tasks, hours, progress, communication, and expectations between our firm and our clients.

Our meetings provide our clients with updates on our progress, and they help keep everyone educated and informed. Typically for the first month, we will schedule a weekly check-in on a certain day or time of the week. This helps us generate and align expectations and interest and allows the client to address any questions he or she may have.

After the first month, depending on the nature of the client’s case, meetings will typically move to a monthly check in along with regular status updates.

Ongoing Communication Updates
Ongoing Communication Updates

If our client is reaching out to us for status updates, we are not doing our job correctly. We strive to provide our clients with updates through forwarding internal and external emails/ communication and meeting agendas to allow our clients access to track our progress while working together.

For our litigation clients, you can expect weekly summaries of what work was completed for the prior week, how much time was spent on the client’s case, and how the monthly billing is shaping up.
