Our Client, a land developer, came to us to discuss issues regarding a neighbor from an adjacent property who was encroaching onto land. The matter went to litigation and was ultimately resolved via a bench trial in my client’s favor.
A Debtor filed Chapter 11 with another attorney. After numerous setbacks, Debtor came to us seeking advice. We substituted into the case and took the Chapter 11 Plan through confirmation within 6 months, a highly accelerated time frame given the status and complexity of the case. Shortly after substituting in, we filed all necessary initial motions, which were subsequently approved.
After filing for Chapter 7 bankruptcy protection, our Client was sued in Bankruptcy Court in what is known as an adversary proceeding. In many respects, Bankruptcy Adversary Proceedings are similar to State and Federal civil bench trials. Through this adversary proceeding, our Client’s right to discharge certain aspects of his debt was challenged.
We successfully helped a client prevent the forced sale of her property. Client had a lien on her property based on an outstanding judgment against her.
